1. Acceptance of Terms

Welcome to GMIA (Global Medical Information Academy).

These Terms of Use (“Terms”) govern your access to and use of the GMIA website, learning platform, certification programs, products, services, and related content (collectively, the “Services”). The Services are operated by Global Medical Information Academy (“GMIA”, “we”, “us”, or “our”), a business established under the laws of India.

By accessing or using the Services, creating a GMIA account, purchasing a program, enrolling in a certification, or otherwise using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

These Terms apply to all visitors, learners, purchasers, and other users of the Services.

You should read these Terms together with our Privacy Policy and Refund Policy, which form part of your relationship with GMIA.

Electronic Acceptance

By clicking “Create My Account”, “Enroll”, “Purchase”, “I Agree”, or any similar button indicating acceptance, you acknowledge that such electronic acceptance constitutes your legally binding agreement to these Terms.

2. Definitions

For the purposes of these Terms:

“GMIA” means Global Medical Information Academy, operated by [Legal Entity Name], together with its website, learning platform, products, services, and authorized representatives.

“Services” means all educational programs, certification programs, digital learning materials, assessments, examinations, websites, learner dashboards, support services, and other products or services provided by GMIA.

“Program” means any educational or certification course offered by GMIA.

“Certification” means a professional credential awarded by GMIA after a learner has successfully satisfied all applicable certification requirements.

“Learner” means any individual who creates a GMIA account, enrolls in a program, purchases a service, or otherwise accesses the Services.

“Content” means all videos, presentations, slides, documents, assessments, examinations, text, graphics, templates, frameworks, trademarks, logos, designs, downloadable resources, and other educational or digital materials made available through the Services.

“Website” means the GMIA website and any associated learner platform or online portal operated by GMIA.

3. Electronic Communications

By creating a GMIA account or using the Services, you consent to receive communications from GMIA electronically.

These communications may include account notifications, verification emails, password reset emails, purchase confirmations, enrollment confirmations, certification updates, examination information, learner support communications, policy updates, and other information relating to your use of the Services.

You agree that electronic communications satisfy any legal requirement that such communications be provided in writing.

Marketing communications will only be sent where you have provided your consent or where otherwise permitted by applicable law. You may unsubscribe from optional marketing communications at any time. Transactional and service-related communications will continue where necessary for the administration of your account or the Services.

4. Eligibility

To use the Services, you must:

  • Be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher.
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate, complete, and current information when creating your account.
  • Comply with these Terms and all applicable laws and regulations.

By creating an account or using the Services, you represent and warrant that you satisfy these eligibility requirements.

GMIA reserves the right to refuse or terminate access to the Services where these requirements are not met.

5. Learner Accounts

To access certain Services, you must create a GMIA learner account.

You agree to:

  • Provide accurate and complete registration information.
  • Maintain the accuracy of your account information.
  • Keep your login credentials confidential.
  • Notify GMIA promptly if you believe your account has been accessed without authorization.

You are responsible for all activity that occurs under your account.

Each learner account is intended for the personal use of one individual only.

You must not:

  • Share your account with another person.
  • Permit another person to access the Services using your account.
  • Create an account using false or misleading information.
  • Impersonate another individual or organization.

GMIA may require email verification before providing access to certain Services.

If GMIA reasonably believes that an account has been shared, compromised, or used in violation of these Terms, we reserve the right to suspend or terminate the account immediately.

6. Purchases and Payments

Program fees are displayed at the time of purchase.

By purchasing a Program, you agree to pay all applicable fees and any taxes required by law.

All purchases are subject to our Refund Policy.

Unless otherwise stated, payment must be successfully completed before access to a Program is granted.

GMIA reserves the right to modify Program pricing at any time. Any pricing changes will not affect purchases that have already been completed.

Promotional offers are valid only during their stated promotional period and cannot be applied retrospectively.

7. Access to Programs

Upon successful purchase, GMIA grants you a limited, personal, non-exclusive, non-transferable, and revocable licence to access the purchased Program solely for your own educational purposes and subject to these Terms.

Your purchase does not transfer ownership of any Program or Content.

Unless otherwise stated by GMIA, access to a purchased Program will remain available while the Program continues to be offered on the GMIA platform.

GMIA may update, improve, reorganize, or discontinue Programs from time to time. Where a Program is permanently discontinued, GMIA will make reasonable efforts to provide affected learners with prior notice where reasonably practicable.

Access to Programs may be suspended or terminated where required under these Terms, including for violations of GMIA’s policies or conduct that compromises the integrity or security of the Services.

8. Intellectual Property

All Content made available through the Services, including but not limited to videos, presentations, slide decks, documents, assessments, examinations, certification materials, templates, frameworks, graphics, designs, trademarks, logos, software, text, and other educational materials, is owned by or licensed to GMIA and is protected by applicable intellectual property laws.

Your purchase or use of the Services grants you only a limited licence to access the Content for your own personal educational purposes in accordance with these Terms. No ownership rights are transferred to you.

Unless expressly authorized in writing by GMIA, you must not:

  • Copy, reproduce, modify, adapt, translate, or create derivative works from any Content.
  • Share, distribute, sell, sublicense, rent, lease, or otherwise make Content available to any third party.
  • Record, screen capture, photograph, or otherwise reproduce any Program or Content for redistribution.
  • Upload or publish Content on websites, social media platforms, file-sharing services, or other public or private platforms.
  • Use any Content for commercial purposes.
  • Use any Content to develop, train, improve, or support artificial intelligence, machine learning models, or similar technologies.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices.

Any unauthorized use of the Content may result in suspension or termination of your account and may also result in legal action where appropriate.

Nothing in these Terms shall be interpreted as granting any licence to use GMIA’s trademarks, logos, trade names, or branding without prior written permission.

9. Acceptable Use

You agree to use the Services responsibly, professionally, and in accordance with these Terms.

You must not:

  • Share your learner account with another person.
  • Attempt to access another learner’s account.
  • Circumvent or attempt to circumvent security measures or access controls.
  • Interfere with the operation, security, or availability of the Services.
  • Use automated tools, bots, scripts, or other technologies to access or extract Content without GMIA’s prior written permission.
  • Upload malicious software, viruses, or other harmful code.
  • Use the Services for unlawful, fraudulent, or misleading purposes.
  • Misrepresent your identity, qualifications, or professional credentials.
  • Engage in conduct that disrupts the learning experience of other learners.

GMIA reserves the right to investigate suspected violations of these Terms and take appropriate action, including suspension or termination of access where necessary.

10. Assessments and Certification

Certain Programs include assessments and certification examinations.

To earn a GMIA Certification, you must successfully complete all applicable Program requirements, including the certification examination where required.

Completion of learning modules alone does not entitle a learner to receive a GMIA Certification.

GMIA does not issue certificates of completion for Programs that require successful completion of a certification examination.

Learners who do not successfully pass the certification examination may attempt the examination again. GMIA currently places no limit on the number of certification examination retakes unless otherwise stated for a specific Program.

GMIA Certifications are currently valid for the lifetime of the individual to whom they are awarded, unless suspended or revoked in accordance with these Terms.

GMIA reserves the right to establish, modify, or update certification requirements, examination procedures, passing criteria, eligibility requirements, or assessment methods for future learners or future Program versions. Such changes will not normally affect learners who have already enrolled unless required to maintain the integrity, security, or validity of the certification.

11. Certification Integrity

Maintaining the integrity and credibility of GMIA Certifications is fundamental to our mission.

Learners must complete all assessments and certification examinations honestly and independently unless collaboration or external assistance has been expressly permitted by GMIA.

Unless expressly authorized, learners must not:

  • Receive assistance from another person during assessments or certification examinations.
  • Use artificial intelligence tools or automated systems during assessments or certification examinations.
  • Copy, plagiarize, or submit work that is not their own.
  • Misrepresent their identity or permit another individual to complete assessments or examinations on their behalf.
  • Share examination content, assessment questions, model answers, or other confidential certification materials.
  • Engage in any conduct intended to obtain or provide an unfair advantage.

Where GMIA reasonably believes that academic dishonesty, identity fraud, account sharing, unauthorized AI use, examination misconduct, plagiarism, falsification of information, or any other conduct has compromised the integrity of a certification, GMIA reserves the right to:

  • Suspend or terminate the learner’s account.
  • Invalidate examination results.
  • Require reassessment.
  • Withhold certification.
  • Revoke a previously awarded certification.
  • Refuse future access to GMIA Programs or Services.

GMIA’s decisions relating to certification integrity shall be made reasonably and in good faith, taking into account the available evidence and the integrity of the certification process.

12. Program Updates

GMIA is committed to maintaining high-quality educational content that reflects current industry practices and professional standards.

We may update, revise, reorganize, replace, or improve Program content, assessments, learning materials, examination formats, or other aspects of the Services from time to time.

Such updates are intended to improve the learner experience and maintain the relevance, quality, security, or integrity of our Programs.

GMIA does not guarantee that Programs or their Content will remain unchanged throughout the period of access.

Program updates do not constitute a material change to your purchase and do not create any entitlement to a refund or other compensation.

13. Suspension and Termination

GMIA reserves the right to suspend or terminate your access to the Services where we reasonably believe that:

  • You have violated these Terms.
  • You have engaged in academic misconduct or certification misconduct.
  • You have shared your account or permitted unauthorized access.
  • Your use of the Services creates a security risk to GMIA or other learners.
  • Your conduct is unlawful, fraudulent, abusive, or otherwise compromises the integrity or operation of the Services.

Where reasonably practicable, GMIA may notify you before taking action. However, immediate suspension or termination may occur where necessary to protect the security, integrity, or lawful operation of the Services.

Termination or suspension does not affect any rights or obligations that arose before termination.

Sections relating to intellectual property, certification integrity, limitation of liability, governing law, and any other provisions that by their nature are intended to survive termination shall remain in effect after your account has been suspended or terminated.

14. Privacy

Your privacy is important to us.

GMIA collects, uses, stores, and protects personal information in accordance with our Privacy Policy.

By using the Services, you acknowledge that your personal information will be processed as described in the Privacy Policy.

15. Medical and Educational Disclaimer

GMIA provides professional education for individuals working in or aspiring to work in Medical Information and related fields.

The Services are provided solely for educational and professional development purposes.

GMIA does not provide medical, clinical, legal, regulatory, financial, tax, employment, or other professional advice through its Programs or Services.

Learners remain responsible for exercising their own professional judgement and for complying with applicable laws, regulations, employer policies, and professional standards.

Nothing contained within the Services should be interpreted as a substitute for independent professional judgement or expert advice appropriate to a specific situation.

16. Limitation of Liability

To the fullest extent permitted by applicable law, GMIA shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your access to or use of the Services.

GMIA makes reasonable efforts to provide accurate, current, and high-quality educational content. However, the Services are provided for educational purposes, and GMIA does not warrant that the Services will be uninterrupted, error-free, or suitable for every learner’s individual circumstances.

GMIA does not guarantee employment, career advancement, salary increases, professional recognition, business opportunities, interviews, promotions, or any specific outcome resulting from participation in its Programs or Certifications.

Nothing in these Terms excludes, limits, or restricts any liability that cannot lawfully be excluded or limited under applicable law, nor does it limit your statutory rights where such rights cannot legally be waived.

Each limitation and exclusion of liability contained in these Terms operates independently and shall remain effective to the fullest extent permitted by applicable law.

17. Force Majeure

GMIA shall not be responsible for any delay, interruption, or failure to perform its obligations where such delay or failure results from events beyond its reasonable control.

Such events may include, but are not limited to:

  • Natural disasters
  • Fire or flood
  • Pandemic or public health emergency
  • War, terrorism, civil unrest, or governmental action
  • Internet, telecommunications, cloud service, or hosting failures
  • Cybersecurity incidents
  • Power failures
  • Labour disputes
  • Any other event beyond GMIA’s reasonable control

Where reasonably practicable, GMIA will make reasonable efforts to restore the Services as soon as circumstances permit.

18. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to the Services shall be governed by and interpreted in accordance with the laws of India, without regard to its conflict of law principles.

The parties shall first make reasonable efforts to resolve any dispute through good-faith discussions.

If a dispute cannot be resolved through good-faith discussions, the parties agree to submit the dispute to mediation or arbitration where mutually agreed or required by applicable law before commencing court proceedings.

Subject to the above, the courts located in Bengaluru, Karnataka, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

19. Assignment

GMIA may assign, transfer, or otherwise delegate its rights and obligations under these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, sale of assets, or other business transaction, provided that such assignment does not materially reduce your rights under these Terms.

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without the prior written consent of GMIA.

Any attempted assignment in violation of this section shall be null and void.

20. Independent Relationship

Nothing contained in these Terms or arising from your use of the Services shall be interpreted as creating any partnership, joint venture, agency, employment, fiduciary, franchise, or other similar relationship between you and GMIA.

Your participation in any Program or Certification does not authorize you to represent, bind, or act on behalf of GMIA in any capacity unless expressly authorized by GMIA in writing.

21. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and GMIA regarding your use of the Services.

They supersede all prior or contemporaneous discussions, communications, representations, understandings, or agreements relating to the Services.

22. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court or other competent authority, that provision shall be interpreted, modified, or, where necessary, severed only to the minimum extent required by law.

The remaining provisions shall continue in full force and effect.

23. Waiver

Failure or delay by GMIA in exercising any right, remedy, or provision under these Terms shall not constitute a waiver of that right or any other right.

Any waiver by GMIA shall be effective only if made expressly and in writing.

A waiver on one occasion shall not constitute a continuing or future waiver of the same or any other right.

24. Changes to These Terms

GMIA may update these Terms from time to time to reflect changes to applicable laws, our Programs, our Services, or our business operations.

The most current version will always be published on the GMIA website and will become effective upon publication unless otherwise stated.

Where changes materially affect your rights or obligations, GMIA will make reasonable efforts to notify affected learners using appropriate means, including through the website, learner dashboard, or email.

Your continued use of the Services after revised Terms become effective constitutes your acceptance of the updated Terms.

26. Interpretation

The headings used in these Terms are included for convenience only and do not affect the interpretation of any provision.

Words importing the singular include the plural and vice versa where the context requires.

References to “including” or similar expressions shall be interpreted as meaning “including without limitation.”
